Motes App End User License Agreement
1. GENERAL TERMS
This End User License Agreement (“Agreement”) is between you and teledep.dev and governs use of Motes mobile application (“Application”). By downloading, accessing or using the Application, you agree to be bound by this agreement. We reserve the right to amend these terms and conditions at any time. If you disagree with any of these Agreement terms, you must immediately discontinue your access to the Application and your use of the services offered on the Application. Continued use of the Application will constitute acceptance of this Agreement, as may be amended from time to time.
2. LIMITED LICENSE
teledep.dev grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial purposes. You may only use the Application on devices that you own or control and as permitted by the relevant application store Terms of Service.
3. WARRANTY
teledep.dev disclaims all warranties about the Application to the fullest extent permitted by law: either express, implied, or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, and of noninfringement of third-party rights. You expressly acknowledge and agree that the use of the licensed Application is at your sole risk. The Application is provided “as is” and “as available”, with all faults and without warranty of any kind. Should the licensed Application or services prove defective, you assume the entire cost of all necessary servicing, repair or correction. To the extent any warranty exists under law that cannot be disclaimed, teledev.dep shall be solely responsible for such warranty.
4. MAINTENANCE AND SUPPORT
The Application does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, teledev.dep shall be obligated to furnish any such maintenance or support.
5. PRODUCT CLAIMS
teledep.dev is responsible for addressing any claims by you relating to the Application or use of it, including, but not limited to: (i) any product liability claim; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.
6. THIRD PARTY INTELLECTUAL PROPERTY CLAIMS
teledep.dev shall not be obligated to indemnify or defend you with respect to any third party claim arising out or relating to the Application. To the extent teledep.dev is required to provide indemnification by applicable law, teledep.dev shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Application or your use of it infringes any third party intellectual property right.
7. FEE & SUBSCRIPTION
The Application is supported by subscription enabling all features and services. A subscription functions as an “in-app” purchase option, which will open access to all full version features. Subscriptions renew on a periodic basis (as designated by teledep.dev) unless you indicate and request non-renewal through the Application. Subscription payments will be processed by a participating mobile app provider, such as Google Play or Apple iTunes, from which you originally downloaded the Application. You may access the applicable “in-app” purchase rules and policies directly from the applicable app store(s). Additional terms or conditions may apply to a subscription at the time of order or renewal.
8. PRIVACY
The Application may collect and use information about your usage of it, including certain types of information from and about your device. The Application may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the Application.
9. FINAL CLAUSES
This Agreement and the relationship between you and Apple shall be governed by the laws of Spain. You and teledep.dev agree to submit to the personal and exclusive jurisdiction of the courts located in Spain to resolve any dispute or claim arising from this Agreement.
